Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Air (“Air”, “we”, “us”), the operator of Agentix Hotel (the “Service”) — a software platform that lets hospitality businesses publish a booking site, manage reservations, front-desk operations, guest services and room service. By creating an account, clicking “I agree”, signing in with Google or Apple, or using the Service in any way, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

• You must be at least 18 years old and able to enter a contract.
• You must use the Service on behalf of a lawful business and provide accurate account information (including a real email address from a supported provider).
• You are responsible for everything done under your account and for keeping your password and staff logins confidential. Notify us immediately of any unauthorised use.

2. What the Service is (and is not)

The Service is a tool. We host software that you use to publish your property, receive bookings and guest requests, run your front desk, housekeeping, maintenance and room service, and view analytics. We are not a hotel, travel agency, booking intermediary, payment processor or party to any transaction between you and your guests. Every booking, stay, charge, refund, dispute and service is solely between you and your guest.

3. Your content and your responsibilities

• You own the content you upload (property details, room types, rates, images, brand assets, staff and guest records — “Your Content”). You grant us a worldwide, non-exclusive licence to host, store, process, display and transmit Your Content solely to operate and improve the Service.
• You are solely responsible for Your Content being accurate, lawful and up to date — including rates, availability, amenities, photographs and marketing claims.
• You are solely responsible for complying with all laws that apply to your business: hospitality licensing, guest registration, health and safety, consumer protection, taxation (including VAT and tourism levies), employment, and data-protection rules covering the guest data you collect through the Service.
• You confirm you have the right to use everything you upload (photos, logos, text) and that it does not infringe anyone’s rights.

4. Guests, bookings and payments

• Bookings, room-service orders and requests submitted by guests are processed by the Service on your behalf and delivered to your dashboard. Honouring bookings, setting rates, collecting payment and resolving disputes are entirely your responsibility.
• The Service re-checks availability to reduce double-bookings, but we do not guarantee that overbooking, pricing mistakes or synchronisation issues will never occur. You must verify critical bookings and keep your own records.
• Unless a payment feature is explicitly provided, the Service does not move money. Settlement with your guests happens outside the Service, and we have no liability for it.
• We may cap, rate-limit or filter public submissions (bookings, orders, requests, reviews) to protect the platform from abuse.

5. AI features

• The Service includes AI features (content generation, descriptions, images, guest chat, the command bar). AI output can be inaccurate, incomplete or inappropriate. You must review AI output before publishing or acting on it. You are responsible for whatever you publish, including AI-generated text, rates and images.
• Content you submit to AI features may be processed by third-party AI providers to generate the output. Do not submit content you are not permitted to share.
• AI usage is metered per your plan. We may change models, providers, quotas or the availability of AI features at any time.

6. Plans, trials and billing

• New accounts start with a free trial. When the trial ends, a paid subscription is required for continued access to the studio; your public booking page may remain live during a grace period and may be taken offline if the account remains unpaid.
• Fees, quotas and plan features are shown on the pricing page and may change; we will give reasonable notice of price increases, which apply from your next billing period.
• Cancelling. You may cancel at any time from your account. Cancelling stops further charges; you keep access until the end of the period you have paid for, after which the studio locks for a grace period and the account then suspends. Nothing is deleted.
• Refunds. Your first payment, and any annual renewal payment, is refunded in full if you ask within 14 days of the charge. After that you may keep your access to the end of the paid period, or end it early and be refunded the unused whole days less an administrative deduction of up to 3%. Billing errors and duplicate charges are always refunded in full. A refund ends the subscription immediately and is paid to the original card through our payment provider. Account credit is applied to future charges and is not paid out; unused quota does not roll over or convert to money. The full rules are in our Refund & Cancellation Policy, which forms part of these Terms.

7. Acceptable use

You must not:

• use the Service for anything unlawful, deceptive or harmful;
• upload malicious code, probe or overload our systems, or bypass security or rate limits;
• scrape, resell or white-label the Service without our written consent;
• reverse-engineer the Service except where the law grants that right;
• submit fake bookings, fake reviews, or content that infringes others’ rights or is abusive or discriminatory.

8. Third-party services

The Service interoperates with third parties — for example Google and Apple sign-in, WhatsApp, hosting providers, AI model providers and our card payment provider Thawani (Thawani Technologies, Oman). Their services are governed by their own terms, and we are not responsible for their availability, acts or omissions.

9. Availability and changes

We aim for the Service to be reliable but we do not promise uninterrupted, error-free or loss-free operation. We may modify, suspend or discontinue any feature (or the Service) at any time, and we may impose limits to protect the platform. You are responsible for keeping your own copies of critical business records.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING. NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICE (INCLUDING AI OUTPUT) CREATES ANY WARRANTY.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST GOODWILL OR BUSINESS INTERRUPTION (INCLUDING LOSSES FROM OVERBOOKING, PRICING ERRORS OR MISSED BOOKINGS), EVEN IF ADVISED OF THE POSSIBILITY; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR TEN OMANI RIALS (OMR 10) IF YOU HAVE PAID NOTHING. THESE LIMITS APPLY TO ANY THEORY OF LIABILITY AND SURVIVE TERMINATION. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

12. Indemnification

You will defend, indemnify and hold harmless Air and its owner, affiliates and personnel from and against any claims, damages, fines, costs and expenses (including reasonable legal fees) arising from: (a) Your Content; (b) your property, accommodation or services; (c) your dealings with guests, staff or suppliers; (d) your breach of these Terms; or (e) your violation of any law or third-party right.

13. Suspension and termination

• You may stop using the Service and cancel at any time from your account. A refund granted under the Refund & Cancellation Policy ends your subscription immediately.
• We may suspend or terminate your account (with or without notice) if you breach these Terms, create risk or legal exposure for us, fail to pay, or if we discontinue the Service. Where reasonable, we will give you an opportunity to export Your Content.
• Sections 3, 4 and 10–15 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the Sultanate of Oman. The courts of Muscat, Oman have exclusive jurisdiction over any dispute arising out of or relating to the Service or these Terms, and you consent to that venue.

15. Changes to these Terms; general

• We may update these Terms. Material changes will be announced in the Service or by email; continued use after the effective date means you accept the updated Terms.
• If a provision is unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganisation or sale.
• These Terms, the Privacy Policy and the Refund & Cancellation Policy are the entire agreement between us regarding the Service.
